The Challenge
The Minister of the Environment has issued a notice of intent to issue a notice under section 46 of the Canadian Environmental Protection Act, 1999 (the Act) with respect to reporting of certain plastic products for 2024, 2025, and 2026. The notice is part of the Government of Canada's initiative to address plastic pollution and create a circular economy for plastics.
The notice will require that any person who manufactures or imports plastic products in Canada provide the Minister with information on the type, source, quantity, and category of the plastic products, as well as the intended use and end-of-life management of the products. The notice will apply to the plastic products listed in Schedule 1 of the notice, which include packaging, single-use or disposable items, electronic and electrical equipment, tires, transportation, construction, white goods, agriculture and horticulture, fishing and aquaculture, textiles and apparel, and other products.
The notice will apply to the calendar years 2024, 2025, and 2026. Information pertaining to each calendar year will be required to be provided no later than September 29 of the following year, using the online portal provided by ECCC. The notice will also require that any person subject to the notice keep copies of the information, calculations, measurements, and other data for a period of three years from the date the information is required to be submitted. Where the person chooses to keep the information at the parent company in Canada, that person will inform the Minister of the civic address of that parent company.
The notice will enable the Minister to create an inventory of data on plastic products in Canada, which will inform the development and implementation of regulations and other measures to reduce plastic waste and increase the recycling and recovery of plastic products. The notice will also support Canada's commitments under the Canada-wide Strategy on Zero Plastic Waste and the Ocean Plastics Charter.
